Defendant Southwest Slopes, Inc. (Southwest), appeals the circuit courts May 12, 1993 Judgment, upon a jury verdict, in favor of Plaintiff Create 21 Chuo, Inc. (Create 21), that (1) rescinded the land sale contract entered into by the parties; (2) pursuant to Hawaii Revised Statutes (HRS) § 449-16.5 (1985), awarded Create 21 recovery of the amount of its aggregate deposits held in escrow, together with all interest earned thereon; and (3) denied Southwests counterclaim for damages, permission to retain the $500,000 deposit, and prejudgment interest. We affirm.
